This Liability & Damage Disclaimer ("Disclaimer") explains how Goobii handles liability and damage claims for its mobile car-cleaning services. It forms part of, and should be read with, our Terms & Conditions. It is to be applied consistently with the UAE Civil Transactions Law (Federal Law No. 5 of 1985, as amended) and the UAE Consumer Protection Law (Federal Law No. 15 of 2020). Nothing in this Disclaimer excludes or limits any liability that cannot be excluded or limited under UAE law, including liability for fraud, gross negligence, or death or personal injury caused by negligence.
1. Our duty of care
Goobii performs each service with reasonable skill and care, using products and methods appropriate to the Service tier you selected, and takes reasonable care when handling your vehicle.
2. Vehicle condition and disclosure
2.1. You must inform us, before the wash, of any pre-existing damage, loose or fragile fittings, aftermarket parts, paint defects, rust, chips, wraps, sensitive electronics, or any feature requiring special care.
2.2. Pre-existing conditions. Goobii is not responsible for pre-existing damage, or for wear, defects or weaknesses that become more apparent or that worsen during normal cleaning despite reasonable care (for example, already-loose trim, failing seals, existing scratches, or paint that was already lifting).
2.3. Personal items. Please remove all valuables and personal items before the wash. Goobii is not responsible for loss of, or damage to, items left in or on the vehicle.
3. Reporting damage
3.1. Any claim that damage was caused during a service must be reported to Goobii at the time of service or within 24 hours of completion.
3.2. Goobii's team takes before-and-after photographs and video of every service (see the Terms & Conditions and Privacy Policy). This documentation is the primary reference in assessing any damage claim. Where possible, you should additionally provide your own photographs and a description to enable investigation — before-and-after evidence assists both parties.
3.3. Goobii will investigate promptly and fairly. Claims reported after the 24-hour window may be difficult to verify and may be declined, except where UAE law requires otherwise.
4. Our liability
4.1. Where Goobii is found to have caused damage to your vehicle through its negligence or breach, Goobii will, at its option, arrange or pay for reasonable repair of the damage caused, or provide appropriate compensation.
4.2. Limit of liability. To the maximum extent permitted by UAE law, Goobii's total aggregate liability arising out of or in connection with any single service is limited to the reasonable cost of repairing the damage actually caused by Goobii, and in any event shall not exceed the total amount paid by you for that service — except where a higher amount is required by UAE law (including non-waivable consumer rights, fraud, gross negligence, or death or personal injury caused by negligence, to which this cap does not apply).
4.3. Indirect loss. To the extent permitted by law, Goobii is not liable for indirect, special or consequential loss, including loss of use, loss of time, or loss of profit.
5. Matters outside our control
Goobii is not responsible for any delay or failure to perform, or for loss, caused by events beyond its reasonable control, including severe weather, floods, fire, road or access restrictions, utility failures, governmental action, or other force majeure.
6. Location and permissions
You are responsible for ensuring the wash location is safe and that washing is permitted there (see the Terms & Conditions, "Where we operate"). Goobii is not liable for fines, penalties, or third-party claims arising from a location you selected at which washing was not permitted, including RTA paid parking.
7. Health and safety
Our team may decline or stop a service if conditions are unsafe. Please keep children and pets clear of the working area during the service. Goobii is not liable for loss or injury arising from a failure to observe reasonable safety requests.
8. Insurance
Goobii maintains appropriate operational arrangements consistent with its activities. Validated claims falling within Goobii's responsibility are handled in accordance with clause 4.
9. Your statutory rights
This Disclaimer does not affect your rights as a consumer under UAE law. Where any limitation in this Disclaimer conflicts with a right that you cannot waive under UAE law, that statutory right prevails to the extent of the conflict.
